Maharashtra: Supreme Court Decision On Shiv Sena Pushed To Monday

Pune, 4th August 2022: The Supreme Court’s decision regarding the claim on Shiv Sena continues to remain pending today. The court will now hear the claims of Eknath Shinde and Uddhav Thackeray on Monday.

Meanwhile, the Supreme Court has asked the Election Commission not to take any decision on the claims of different factions of the Shiv Sena till further orders. Hence, the decision regarding Shiv Sena and the fight for the claim on the party continues to be protracted. The court further established that, presently, the Shinde faction should not decide to recognize itself as the real Shiv Sena.

The Eknath Shinde faction, demanding from the Election Commission that their faction is the real Shiv Sena, has asked for the party’s symbol arrow and bow to be allocated to them. The Supreme Court told the Election Commission to permit Uddhav Thackeray with the opportunity if he asks for time to reply on the issue. Along with this, the court declared that the matter will be heard on August 8, Monday.

The court also stated that it will consider if the matter should be put before the Constitutional Bench of 5 judges on Monday. During the hearing, the lawyers of the Eknath Shinde faction said that Uddhav Thackeray had resigned from the post, and the state could not be kept without the government for long. Further, the Shinde faction said that they have a majority.

On the other hand, Kapil Sibal, representing Uddhav Thackeray, said that it is not necessary to send the matter to the Constitutional Bench, claiming that the current bench can also hear the matter.
