Tamil Nadu Government Challenges Validity Of NEET, Files Petition In Supreme Court

New Delhi, 19th February 2023: The Tamil Nadu government has moved the Supreme Court (SC) challenging the validity of the National Eligibility cum Entrance Test (NEET) for admission to medical courses in colleges across the country, alleging that the single window common test violates the principle of federalism.

NEET is a pre-medical entrance exam for admission to undergraduate medical courses like MBBS and BDS and postgraduate courses in government and private medical colleges.

In a suit filed under Article 131 of the Constitution, the Tamil Nadu Government has alleged that the principle of federalism, which is part of the basic structure of the Constitution, is being violated by exams like NEET as it is a decision regarding the education of the states.

The petition, filed through advocate Amit Anand Tiwari, said that the apex court had upheld the validity of NEET in 2020 on the ground that granting admission based on paying capacity of the candidates, charging capitation fees, and rampant malpractice was necessary to curb the evil of unfair practices like exploitation, profiteering and commercialization of students.

However, such grounds are not applicable in the case of admission to government seats, and the logic of the judgment applies only to private college seats. The decision upholding NEET is not binding on any state as far as admission to government seats is concerned.
