Thackeray Group Moves High Court Against Decision To Freeze Name And Symbol Of Shiv Sena
Mumbai, 10th October 2022: The Election Commission has frozen both the Shiv Sena name and the party symbol ‘Arrow and Bow’. Now, Shiv Sena’s Thackeray group has filed a petition in the Delhi High Court against this decision.
Shiv Sena leader Anil Desai opined that the commission did not follow the principle of natural justice and gave a hasty decision without giving them a chance to present their views. He was speaking at a press conference in Delhi.
Desai said, “We have filed a petition in the Delhi High Court against the decision to freeze Shiv Sena’s name and symbol. The principles of natural justice were not followed in this petition. Central Election Commission is an autonomous body. They called for everything related to the party on Saturday (October 8). We presented everything on Saturday itself. However, the commission gave its decision on Saturday night itself, without listening to us.”
“It has some references to the past. The commission needed to give us a hearing and ask questions. Without doing so, the Commission gave a unilateral decision. We have filed a petition in this regard. It will be heard today or tomorrow. As per the list, this petition is likely to come up for hearing tomorrow,” informed Desai.
Will the Delhi High Court grant a stay? Answering this question, Desai said, “We have raised many issues before the Delhi High Court. Even in the Supreme Court, we have mentioned everything from the constitution of the party. Also, the haste taken by the Central Election Commission in taking the decision has been pointed out. There will be an exchange of views in the Delhi High Court.”
