“Will The 50% Limit On Reservation Be Broken,” Question Asked In Supreme Court During Hearing Of EWS Quota

New Delhi, 9th November 2022: Even though the Supreme Court has given its approval on the EWS reservation to the poor of the general category, but during the hearing in the court, many such questions have also been raised, on which the discussion may intensify in future. The most important question is whether in the coming time, the limit of 50 percent reservation fixed by the 9-member bench of the Supreme Court will end.
During the hearing on EWS quota, the Supreme Court did not comment openly on this question, but the opinion of the majority was there. During the hearing, the Attorney General had raised the question that the 50 percent limit of reservation should also be considered. The court did not comment on this, but arguments were made on this by the lawyers.
Justice Dinesh Maheshwari, who wrote the judgment on behalf of the majority judges, said that the 50 per cent limit that the court had earlier set is not such that it cannot be changed. He said that the 50 per cent limit is not a necessary provision of the Constitution.
It was made clear by Justice Ravindra Bhat that a hearing in a separate bench is going on in Tamil Nadu regarding more than 50 percent reservation.
